Terms on the use of the « VINILKOSMO-MP3.com « VINILKOSMO-MP3.com » On-Line Downloading Service

ARTICLE 1 GENERALITIES
The present conditions regulate VINILKOSMO’s on-line sales.
On-line sales concern downloadable albums, songs, and videos.
You are committed to giving real and true data about yourself.
The present provisions must be understood without prejudice to legal provisions in this matter, and especially those applied by consumer codes.
This VINILKOSMO service is reserved for private individuals and adults, and may not be used for professional purposes.
VINILKOSMO may carry out all modifications that it judges necessary for this service. The general sales conditions will then be those in validity on the site at the date of the order confirmation. We therefore invite you to return regularly in order to keep up with the service’s development.
Without proof to the contrary, the data recorded by VINILKOSMO constitutes the proof of all the transactions carried out by VINILKOSMO and its customers.

ARTICLE 2 - CREATING AN ACCOUNT / PASSWORD
In order to make an order on the site, you must :
- Create a Customer Account on VINILKOSMO-mp3.com, or sign in if you already have a Customer Account on VINILKOSMO-mp3.com.
- Have a payment card (bank or credit card), or a Paypal account.
The Customer Account will give the customer access to our services, and may be reached with an identifier and a password.
The customer can modify his password upon reaching the section «Profile» on the site.
The customer must immediately inform VINILKOSMO of any loss or unauthorized use of his account, of his identifier, or password. The password and identifier are personal, and you are committed not to reveal them. You alone are responsible for their use.
Any attempt to substitute another customer’s password or identifier is strictly forbidden.

ARTICLE 3 - OFFER
You have several purchasing formulas at your disposal : Two formulas for music : purchasing individual song titles, or purchasing whole albums.
The conditions of use (downloading, number of burns, number of transfers possible…) have been established between the VINILKOSMO label and the artists. They have been specified in the General Sales Conditions, and are susceptible to change.
Downloads are made piecemeal, title by title or album by album, or also video by video.
The conditions of use are defined exclusively by VINILKOSMO.

ARTICLE 4 - CONDITIONS OF USE OF DIGITAL FILES
For music, albums, and videos : we remind you that downloaded files are reserved to private use.

ARTICLE 5 - ORDERS
The transaction history between the service and the customer is consultable at any moment on the site in the section «Profile», «Orders».
VINILKOSMO reserves the right to cancel or refuse any order from a customer with whom there is conflict concerning payment of a previous order. The filing of order forms and bills is carried out in a trustworthy and longlasting medium (paper), that can be exhibited as proof.

ARTICLE 6 - TERRITORY
Except for information to the contrary relating to restrictions of distribution licences, the files bought on VINILKOSMO-mp3.com are accessible throughout the world.

ARTICLE 7 - PRICES
Our articles’ prices are shown in Euros, including all sales tax. VINILKOSMO reserves the right to modify its prices or the present General Conditions at any moment, but the products or services will be billed on the basis of the tariffs and conditions valid at the moment of recording the orders.

ARTICLE 8 - PAYMENT
The payment of your purchases are carried out :
- by bank card : Visa, MasterCard, Carte Bleue.
The card is debited in the hours following the order.

ARTICLE 9 - RETRACTION RIGHTS
The purchasing of titles, albums, and videos are firm and definite. There can therefore be no exchanges, reimbursements, or retractions.

ARTICLE 11 - INTELLECTUAL PROPERTY
All the musical files, texts, commentaries, illustrations, and pictures reproduced on VINILKOSMO-mp3.com are reserved by copyright as well as by intellectual property by their holders and for the whole world. Therefore, and in conformity with the provisions of the Code of Intellectual Property, only private use is permitted, on reserve of different provisions and even limiting conditions of the code of intellectual property.
Any reproduction of all or of part of the VINILKOSMO site for any reason other than those of its normal use, is strictly forbidden. Any sales, exchange, or rental of the files, or transfer to a third party is strictly forbidden.
We remind you that « watermarking » designates a system protecting digital files, notably enabling the uncovering of the intial customer in case of illegal copies. The possibilities of burning and of transfering in no way justifies the misdoer, and the rights holders do not renounce their rights concerning the delivered files.
Concerning the music files, VINILKOSMO reminds you that only it has the right to distribute these files with the concerned artists’ trust, and that these music files are protected under national and international copyright regulations.
The customer only has the right to private use of these music files, limited by the indications described in the General Sales Conditions, in a purely private and free framework. Any use outside of that defined framework is strictly forbidden, and any use other than private will expose the customer to civil or penal legal persuit.
In the hypothesis that the music files accessible at VINILKOSMO contains identifying mentions and/or technical means for checking on and limiting use, or protection to others, you are committed to respect those mentions and means without either modifying or eliminating them.
You are committed not to attempt getting around or modifying the programs necessary to using the service, and not to violate the present conditions, nor to hinder, modify, or erase any data concerning the copyright rules on musical productions, nor support or help others to carry out such acts.

ARTICLE 12 - COMMITMENT IN USING THE SERVICE - RESPONSIBILITY

12.1 - COMMITMENT OF USE
You are committed :
not to use the Service toward illegal ends.
not to make commercial use of the data, services, and content found on the VINILKOSMO-mp3.com site.

12.2 - RESPONSIBILITY
VINILKOSMO is in no way responsible for technical problems independant of its service, such as problems of connection due to the customer’s Internet provider (slowness and breaks are always possible.)
For technical reasons, notably due to maintenance or network breakdown, a momentary interruption of service is possible.
You acknowledge that you understand and accept the constraints and limitations of the Internet network, notably concerning data transmission via the network and data damage.
The customer alone is responsible of the use he makes of the service, and may not blame VINIKOSMO for any complaints or legal procedures against him.

ARTICLE 13 - APPLICABLE RIGHTS – LITIGATION
The present contract is valid under French law.
The language of the present contract is English as translated from the French original.
In case of litigation, only the French courts are competent.

ARTICLE 14 - NOMINAL INFORMATION
The information and data concerning you is necessary to the processing of your order and to our business relations. According to your choices made on the inscription form, you may receive offers from our label if you have accepted it when making your order. Consequently, in conformity with the French Data-Processing and Freedom Law of the 6th of January 1978, you have the right to gain access to, to rectify, and to oppose any personal data concerning yourself. To this end, all you have to do is send an e-mail request or a letter indicating your family name, given name, address, and if possible your customer reference number.
Our site has also been set up to be particularly attentive to our customers’ needs. For this reason, we use cookies. Cookies are used to signal your passage on our site. Cookies are therefore only used by VINILKOSMO-mp3.com to improve the personalized service we reserve you.

ARTICLE 15 - VALIDATION
You declare that you have understood and accepted the conditions for ordering, notably the information on the characteristics of the products or services ordered, the price, the datelines, the delivery, as well as the present General Conditions of Use, before making your order. You declare to have full legal capacity to make an order and to accept the present General Conditions of Use.
